Any access to or use of the Site constitutes acceptance of all the provisions set out below.<\/p><p data-start=\"1572\" data-end=\"1854\">1.4 The version of the TOU in force is the one published on the Site at the time of consultation. The Company reserves the right to modify these terms at any time, without prior notice, notably to comply with any legislative, regulatory or technical development.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-4ce80ae elementor-widget elementor-widget-text-editor\" data-id=\"4ce80ae\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h3 data-start=\"1861\" data-end=\"1896\">2. Purpose and scope<\/h3><p data-start=\"1898\" data-end=\"2003\">2.1 The purpose of these Terms of Use is to define the conditions underised which Users may:<\/p><ul data-start=\"2004\" data-end=\"2296\"><li data-start=\"2004\" data-end=\"2048\"><p data-start=\"2006\" data-end=\"2048\">access the Site and its features; ;<\/p><\/li><li data-start=\"2049\" data-end=\"2115\"><p data-start=\"2051\" data-end=\"2115\">consult the information and content published by the Company; ;<\/p><\/li><li data-start=\"2116\" data-end=\"2230\"><p data-start=\"2118\" data-end=\"2230\">make bookings, purchase gift vouchers, or manage their activity credits via the online system; ;<\/p><\/li><li data-start=\"2231\" data-end=\"2296\"><p data-start=\"2233\" data-end=\"2296\">interact with the suggested contact or registration tools.<\/p><\/li><\/ul><p data-start=\"2298\" data-end=\"2611\">2.2 These ToU also apply to any use of the mobile application connected to the system <strong data-start=\"2403\" data-end=\"2418\">Apex Timing<\/strong>, operated under licence by the Company, as well as to any associated interface or service (forms, payment system, customer accounts, booking or gift voucher issuance modules).<\/p><p data-start=\"2613\" data-end=\"2755\">2.3 They supplement, where applicable, the General Conditions of Sale (GCS) and the Privacy Policy published on the same domain.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-80769e4 elementor-widget elementor-widget-text-editor\" data-id=\"80769e4\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h3 data-start=\"2762\" data-end=\"2780\">3. Definitions<\/h3><p data-start=\"2782\" data-end=\"2866\">For the purposes of these T&amp;Cs, the following terms shall have the meanings set out below:<\/p><ul data-start=\"2868\" data-end=\"3766\"><li data-start=\"2868\" data-end=\"2987\"><p data-start=\"2870\" data-end=\"2987\"><strong data-start=\"2870\" data-end=\"2885\">\u00abCompany\u00bb<\/strong> : Del\u00e9mont Sports and Leisure Centre Ltd, owner and operator of the Site and the Application.<\/p><\/li><li data-start=\"2988\" data-end=\"3093\"><p data-start=\"2990\" data-end=\"3093\"><strong data-start=\"2990\" data-end=\"3009\">\u00abUser\u00bb<\/strong> : anyone accessing the Site or the Application or using a proposed service.<\/p><\/li><li data-start=\"3094\" data-end=\"3248\"><p data-start=\"3096\" data-end=\"3248\"><strong data-start=\"3096\" data-end=\"3122\">\u00abUser account\u00bb<\/strong> : personal space created by a User to access certain features (booking, purchasing, order tracking).<\/p><\/li><li data-start=\"3249\" data-end=\"3373\"><p data-start=\"3251\" data-end=\"3373\"><strong data-start=\"3251\" data-end=\"3267\">\u00abServices\u00bb<\/strong> all the features, content, interfaces and products offered via the Site or the Application.<\/p><\/li><li data-start=\"3374\" data-end=\"3505\"><p data-start=\"3376\" data-end=\"3505\"><strong data-start=\"3376\" data-end=\"3395\">\u00abApex Timing\u00bb<\/strong> third-party software used by the Company for the technical management of bookings, subscriptions and activities.<\/p><\/li><li data-start=\"3506\" data-end=\"3620\"><p data-start=\"3508\" data-end=\"3620\"><strong data-start=\"3508\" data-end=\"3523\">\u00abContent\u00bb<\/strong> : any text, image, video, graphic element, logo, data or structure accessible on the Site.<\/p><\/li><li data-start=\"3621\" data-end=\"3766\"><p data-start=\"3623\" data-end=\"3766\"><strong data-start=\"3623\" data-end=\"3651\">\u00abPersonal data\u00bb<\/strong> : any information relating to an identified or identifiable person in accordance with Swiss legislation (FADP).<\/p><\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-65c70bc elementor-widget elementor-widget-text-editor\" data-id=\"65c70bc\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h3 data-start=\"3773\" data-end=\"3807\">4. Acceptance and enforceability<\/h3><p data-start=\"3809\" data-end=\"4006\">4.1 By accessing the Site, the User acknowledges having read and unreservedly accepted these Terms of Use in their entirety.<br data-start=\"3923\" data-end=\"3926\" \/>No registration or use may be made without this acceptance.<\/p><p data-start=\"4008\" data-end=\"4257\">4.2 The User declares that they have the legal capacity to enter into a contract under Swiss law. Minors must obtain the prior authorisation of their legal representative to use the Services requiring a purchase or the transmission of data.<\/p><p data-start=\"4259\" data-end=\"4440\">4.3 These Terms of Use are binding upon any User for the entire duration of the use of the Site and for as long as data or contractual relations exist between the parties.<\/p><p data-start=\"4442\" data-end=\"4584\">4.4 In the event of disagreement with any of the provisions hereof, the User must immediately cease using the Site and its Services.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-14b7bba elementor-widget elementor-widget-text-editor\" data-id=\"14b7bba\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h3 data-start=\"4591\" data-end=\"4628\">5. Site access and availability<\/h3><p data-start=\"4630\" data-end=\"4851\">5.1 Access to the Site is open to anyone with an Internet connection.<br data-start=\"4713\" data-end=\"4716\" \/>The Company endeavours to ensure continuous access but does not guarantee that the Site will be free from errors, outages or interruptions.<\/p><p data-start=\"4853\" data-end=\"5015\">5.2 Access to the Site or certain features may be temporarily suspended for maintenance, update, or security reasons without prior notice.<\/p><p data-start=\"5017\" data-end=\"5193\">5.3 The Company cannot be held liable for damages resulting from temporary unavailability of the Site, including the loss of data, information or profits.<\/p><p data-start=\"5195\" data-end=\"5388\">5.4 Access to the mobile application is subject to the same conditions, it being understood that it relies on the technical platform <strong data-start=\"5320\" data-end=\"5335\">Apex Timing<\/strong>, the availability of which depends on third-party service providers.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-ff7728e elementor-widget elementor-widget-text-editor\" data-id=\"ff7728e\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h3 data-start=\"5395\" data-end=\"5443\">6. User account creation and management<\/h3><p data-start=\"5445\" data-end=\"5605\">6.1 Some features require the creation of an <strong data-start=\"5504\" data-end=\"5536\">personal user account<\/strong> (reservation, voucher purchases, credit management, activity tracking).<\/p><p data-start=\"5607\" data-end=\"5804\">6.2 When registering, the User must provide accurate, up-to-date and complete information, such as surname, first name, email address, and where applicable, telephone number or postal address.<\/p><p data-start=\"5806\" data-end=\"5987\">6.3 The User undertakes to keep this information up to date. The Company reserves the right to suspend or delete any account containing inaccurate or fraudulent data.<\/p><p data-start=\"5989\" data-end=\"6149\">6.4 The username and password are strictly personal and confidential. Any use of the account shall be deemed to have been made by the User concerned.<\/p><p data-start=\"6151\" data-end=\"6326\">6.5 In the event of suspected unauthorised access, the User must immediately notify the Company at the address <a class=\"decorated-link cursor-pointer\" rel=\"noopener\" data-start=\"6262\" data-end=\"6325\">contact@raiffeisen-parc.ch<\/a>.<\/p><p data-start=\"6328\" data-end=\"6505\">6.6 Account deletion by the User shall result in the deletion of their personal data within the limits provided for by Swiss law and the Privacy Policy.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-3f5dfd1 elementor-widget elementor-widget-text-editor\" data-id=\"3f5dfd1\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h3 data-start=\"6512\" data-end=\"6547\">7. User obligations<\/h3><p data-start=\"6549\" data-end=\"6575\">The User undertakes to:<\/p><p data-start=\"6577\" data-end=\"6685\">7.1 To use the Site and the Application in a fair manner, in accordance with Swiss law and these T&amp;Cs.<\/p><p data-start=\"6687\" data-end=\"6831\">7.2 Not to use the Site for fraudulent, illegal, defamatory, or offensive purposes, or in any way that infringes the rights of others.<\/p><p data-start=\"6833\" data-end=\"6959\">7.3 Not to attempt to access unauthorised areas of the server, nor to tamper with the operation of the Site or the Application.<\/p><p data-start=\"6961\" data-end=\"7073\">7.4 Do not extract, duplicate or exploit the content of the Site for commercial purposes without written authorisation.<\/p><p data-start=\"7075\" data-end=\"7221\">7.5 Comply with the rules of digital etiquette and refrain from any misuse that could compromise the security or integrity of the Website.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-37cb56d elementor-widget elementor-widget-text-editor\" data-id=\"37cb56d\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h3 data-start=\"7228\" data-end=\"7289\">8. Obligations of Centre de sports et loisirs Del\u00e9mont SA<\/h3><p data-start=\"7291\" data-end=\"7418\">8.1 The Company uses all reasonable means to ensure the proper functioning of the Site and data security.<\/p><p data-start=\"7420\" data-end=\"7441\">8.2 She undertakes to:<\/p><ul data-start=\"7442\" data-end=\"7684\"><li data-start=\"7442\" data-end=\"7509\"><p data-start=\"7444\" data-end=\"7509\">guarantee reliable hosting via Hostinger International Ltd. ;<\/p><\/li><li data-start=\"7510\" data-end=\"7606\"><p data-start=\"7512\" data-end=\"7606\">keep the necessary software systems (Apex Timing, payment modules, etc.) up to date; ;<\/p><\/li><li data-start=\"7607\" data-end=\"7684\"><p data-start=\"7609\" data-end=\"7684\">comply with Swiss data protection legislation (FADP).<\/p><\/li><\/ul><p data-start=\"7686\" data-end=\"7754\">8.3 However, the Company cannot be held liable in the event of:<\/p><ul data-start=\"7755\" data-end=\"7942\"><li data-start=\"7755\" data-end=\"7795\"><p data-start=\"7757\" data-end=\"7795\">temporary service interruption; ;<\/p><\/li><li data-start=\"7796\" data-end=\"7878\"><p data-start=\"7798\" data-end=\"7878\">of an anomaly related to external service providers (Apex Timing, Stripe, Brevo, etc.); ;<\/p><\/li><li data-start=\"7879\" data-end=\"7942\"><p data-start=\"7881\" data-end=\"7942\">of indirect loss or damage arising from the use of the Site.<\/p><\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-ae5137c elementor-widget elementor-widget-text-editor\" data-id=\"ae5137c\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h3 data-start=\"7949\" data-end=\"8000\">9. Content, rights and intellectual property<\/h3><p data-start=\"8002\" data-end=\"8228\">9.1 All elements comprising the Site, in particular texts, images, graphics, logos, icons, videos, databases, and software, are protected by copyright and Swiss intellectual property laws.<\/p><p data-start=\"8230\" data-end=\"8395\">9.2 The \u00abRaiffeisen Parc\u00bb brand, the logo, the names and the associated visual identity are the exclusive property of Centre de sports et loisirs Del\u00e9mont SA.<\/p><p data-start=\"8397\" data-end=\"8552\">9.3 The User is prohibited from reproducing, copying, modifying, distributing, or exploiting any element of the Site without the prior written authorisation of the Company.<\/p><p data-start=\"8554\" data-end=\"8694\">9.4 Any unauthorised reproduction or use constitutes an infringement subject to civil and criminal proceedings under Swiss law.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-94dc26b elementor-widget elementor-widget-text-editor\" data-id=\"94dc26b\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h3 data-start=\"8701\" data-end=\"8729\">10. Personal data<\/h3><p data-start=\"8731\" data-end=\"8849\">10.1 Data processing is carried out in accordance with <strong data-start=\"8796\" data-end=\"8848\">Federal Act on Data Protection (FADP)<\/strong>.<\/p><p data-start=\"8851\" data-end=\"8938\">10.2 The User acknowledges and accepts that their data may be collected during:<\/p><ul data-start=\"8939\" data-end=\"9137\"><li data-start=\"8939\" data-end=\"8969\"><p data-start=\"8941\" data-end=\"8969\">from creating an account; ;<\/p><\/li><li data-start=\"8970\" data-end=\"9021\"><p data-start=\"8972\" data-end=\"9021\">from booking or purchasing a gift voucher; ;<\/p><\/li><li data-start=\"9022\" data-end=\"9073\"><p data-start=\"9024\" data-end=\"9073\">from signing up to a newsletter via <strong data-start=\"9062\" data-end=\"9071\">Brevo<\/strong> ;<\/p><\/li><li data-start=\"9074\" data-end=\"9137\"><p data-start=\"9076\" data-end=\"9137\">from browsing (via cookies, pixels and analytical tools).<\/p><\/li><\/ul><p data-start=\"9139\" data-end=\"9191\">10.3 The data are used exclusively for:<\/p><ul data-start=\"9192\" data-end=\"9318\"><li data-start=\"9192\" data-end=\"9234\"><p data-start=\"9194\" data-end=\"9234\">the management of accounts and transactions; ;<\/p><\/li><li data-start=\"9235\" data-end=\"9271\"><p data-start=\"9237\" data-end=\"9271\">communications and marketing ;<\/p><\/li><li data-start=\"9272\" data-end=\"9318\"><p data-start=\"9274\" data-end=\"9318\">the improvement of services and statistics.<\/p><\/li><\/ul><p data-start=\"9320\" data-end=\"9497\">10.4 The User may at any time exercise their rights of access, rectification or erasure at the address <a class=\"decorated-link cursor-pointer\" rel=\"noopener\" data-start=\"9433\" data-end=\"9496\">contact@raiffeisen-parc.ch<\/a>.<\/p><p data-start=\"9499\" data-end=\"9614\">10.5 The data is hosted within the European Union and retained for the applicable Swiss legal duration.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-918c5b5 elementor-widget elementor-widget-text-editor\" data-id=\"918c5b5\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h3 data-start=\"9621\" data-end=\"9661\">Service security and integrity<\/h3><p data-start=\"9663\" data-end=\"9788\">11.1 The Company implements appropriate technical and organisational measures (encryption, access controls, backups).<\/p><p data-start=\"9790\" data-end=\"10076\">11.2 The User acknowledges that, despite the security measures implemented, the Internet does not guarantee absolute protection.<br data-start=\"9929\" data-end=\"9932\" \/>The Company shall not be held liable for any unauthorised access, loss or alteration of data resulting from a breach beyond its control.<\/p><p data-start=\"10078\" data-end=\"10235\">11.3 In the event of a data breach likely to affect the rights of Users, the Company shall notify the competent authorities in accordance with the FADP.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-969d88b elementor-widget elementor-widget-text-editor\" data-id=\"969d88b\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h3 data-start=\"10242\" data-end=\"10278\">12. Responsibilities and warranties<\/h3><p data-start=\"10280\" data-end=\"10436\">12.1 Use of the Site is at the User's sole responsibility.<br data-start=\"10364\" data-end=\"10367\" \/>The Company guarantees neither the continuity nor the performance of the service.<\/p><p data-start=\"10438\" data-end=\"10501\">12.2 Under no circumstances shall the Company be held liable:<\/p><ul data-start=\"10502\" data-end=\"10735\"><li data-start=\"10502\" data-end=\"10575\"><p data-start=\"10504\" data-end=\"10575\">regarding the unsuitability of the service to the specific needs of the User; ;<\/p><\/li><li data-start=\"10576\" data-end=\"10650\"><p data-start=\"10578\" data-end=\"10650\">consequential damages, loss of profits, or damage to reputation; ;<\/p><\/li><li data-start=\"10651\" data-end=\"10735\"><p data-start=\"10653\" data-end=\"10735\">interruptions caused by third parties or events beyond its control.<\/p><\/li><\/ul><p data-start=\"10737\" data-end=\"10849\">12.3 The User remains solely responsible for the compatibility of their hardware and connection with the Site.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-a1cc973 elementor-widget elementor-widget-text-editor\" data-id=\"a1cc973\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h3 data-start=\"10856\" data-end=\"10912\">13.
